 Abstract 

The article examines the development of the right to privacy in the history of constitutional law. The article presents the Soviet period of the constitutional doctrine, when the Constitution of the USSR provided for the right to protection of personal life. This concept was based on the individual as a special subject of law. This excluded from the number of copyright holders minors, incapacitated, persons serving sentences in places of deprivation of liberty. The modern Russian doctrine uses a new term – «private life», thereby confirming the adherence to general humanitarian principles developed by the entire history of mankind. The analysis of the origin of the American concept of privacy protection is presented. The main conclusions formulated by the American lawyers S. Warren and L. Brandyce in the late XIX – early XX centuries are highlighted. The difference between the protection of private life and the protection of honor and dignity in libel cases is shown.
